These Terms of Service ("Terms") govern your access to and use of Fraggy ("Fraggy", "we", "us", or "our"), including our mobile applications, website, and related services (collectively, the "Service").
By accessing or using Fraggy, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of the Service
Fraggy is a digital tool that helps users capture, organize, and resurface highlighted text and notes from books, documents, and images using OCR and AI-assisted features.
2. Eligibility & Accounts
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Fraggy.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity occurring under your account
Fraggy is not responsible for unauthorized access caused by your failure to secure your account.
3. User Content & Ownership
a) Ownership
You retain full ownership of all content you upload to Fraggy, including text, notes, highlights, images, and metadata ("User Content").
Fraggy does not claim ownership over your content.
b) License to Operate the Service
By using Fraggy, you grant us a limited, non-exclusive, non-transferable, non-sublicensable license to store, process, and display your User Content solely for the purpose of operating and improving the Service.
This license:
- Exists only while you use Fraggy
- Ends when you delete your content or your account, except where retention is required by law
c) Responsibility for Content
You are solely responsible for your User Content and confirm that you have the legal right to upload and use it.
Fraggy does not verify ownership or legality of uploaded content.
4. Prohibited Uses
You agree not to use Fraggy to:
- Upload content that infringes intellectual property rights
- Upload illegal, harmful, or abusive material
- Attempt to reverse-engineer or disrupt the Service
- Use Fraggy for unlawful or unauthorized purposes
- Circumvent subscription or usage limits
We reserve the right to suspend or terminate accounts violating these rules.
5. AI & Automated Processing
Fraggy uses AI-assisted features (including OCR and text analysis) to process User Content.
- AI processing is used only to provide the Service
- User Content is not used to train public or third-party AI models
- We do not sell User Content to third parties
You acknowledge that AI-generated outputs may contain errors and should not be relied upon as authoritative.
6. Third-Party Services
Fraggy may integrate with third-party services (e.g., cloud storage, payment providers, book databases).
Fraggy:
- Is not responsible for third-party services
- Does not control their terms, availability, or behavior
Your use of third-party services is subject to their respective terms.
7. Subscriptions, Trials & Payments
Some features require a paid subscription.
- Subscriptions renew automatically unless canceled
- Prices and features may change with reasonable notice
- Free trials may convert to paid plans unless canceled before the trial ends
Payments are handled by third-party providers (e.g., Apple, Google, Stripe).
Refunds are subject to platform policies and applicable law.
8. Data Retention, Export & Deletion
You may:
- Export your data where supported
- Delete individual content or your entire account
Upon account deletion:
- Your data will be permanently removed within a reasonable timeframe
- Some data may be retained temporarily for legal or operational reasons
9. Service Availability & Changes
We may modify, suspend, or discontinue any part of the Service at any time.
We are not liable for:
- Temporary outages
- Loss of access due to maintenance or updates
- Feature changes
10. Termination
You may stop using Fraggy at any time.
We may suspend or terminate your account if:
- You violate these Terms
- Your use poses risk to the Service or other users
11. Disclaimers
Fraggy is provided "as is" and "as available."
We make no warranties regarding:
- Accuracy of OCR or AI outputs
- Data completeness
- Fitness for a particular purpose
Use of the Service is at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law:
- Fraggy shall not be liable for indirect, incidental, or consequential damages, including loss of data, profits, or business opportunities.
- Our total liability shall not exceed the amount you paid for the Service in the last 12 months.
13. Governing Law & Disputes
These Terms shall be governed by applicable laws based on Fraggy's operating entity at the time of the dispute, without regard to conflict-of-law principles.
Disputes shall be resolved through good-faith negotiation first. Further dispute mechanisms may be defined based on jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time.
We will notify users of material changes through the app or website. Continued use of Fraggy constitutes acceptance of the updated Terms.
